Acceptance of TermsThese Terms of Service ("Terms") constitute a legally binding agreement between you and FluenSpeak regarding your use of the FluenSpeak mobile application (the "App").By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.---2. - Reverse engineer, decompile, or disassemble the App
- Remove, alter, or obscure any proprietary notices
- Use the App for any illegal or unauthorized purpose
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to any portion of the App
- Use the App to harass, abuse, or harm others
- Resell or redistribute the App or any part of it---4. Free and Premium FeaturesFree TierFluenSpeak offers a free tier that includes:- Up to 10 practice sessions
- Voice recording and transcription
- AI-powered speech analysis and feedback
- Practice history (last 50 sessions)Premium SubscriptionPremium subscribers receive:- Unlimited practice sessions
- All features available in the free tier
- Future premium features as they become availableSubscription Terms- Payment: Subscriptions are billed through your Apple App Store account
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Cancellation: You can cancel your subscription at any time through your App Store account settings
- Refunds: All sales are final. Refunds are handled by Apple according to their policies
- Price Changes: We reserve the right to modify subscription prices with 30 days' notice---5. User Content and DataYour Voice Recordings- You retain all rights to your voice recordings
- By using the App, you grant us a limited license to process your voice recordings solely for the purpose of providing transcription and analysis services
- Voice recordings are processed in real-time and are not permanently stored by usAI-Generated FeedbackThe feedback and analysis provided by FluenSpeak are generated by artificial intelligence and are for informational and educational purposes only. They should not be considered professional speech therapy or medical advice.---6. Intellectual PropertyAll content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of FluenSpeak and are protected by copyright, trademark, and other intellectual property laws.---7. Third-Party ServicesFluenSpeak uses third-party services for certain functionalities:- Groq AI: Voice transcription and analysis
- RevenueCat: Subscription management
- Apple App Store: Payment processingYour use of these services is also subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party service providers.---8. Disclaimers and Limitations of Liability"AS IS" BasisTHE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.No Guarantee of ResultsWe do not guarantee that:- The App will meet your expectations or improve your speaking skills
- The AI analysis will be 100% accurate
- The App will be uninterrupted, secure, or error-free
- Any defects will be correctedLimitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENSPEAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS LESS.---9. To cancel your subscription, follow Apple's cancellation process.By UsWe may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.Effect of TerminationUpon termination:- Your right to use the App will immediately cease
- All locally stored data will be deleted when you uninstall the App
- Subscriptions will continue until the end of the current billing period unless you request a refund through Apple---11. Changes to TermsWe reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App or on our website. Your continued use of the App after changes constitutes acceptance of the modified Terms.Material changes will be communicated through the App or via email if we have your contact information.---12. Governing Law and Dispute ResolutionGoverning LawThese Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FluenSpeak operates, without regard to its conflict of law provisions.Dispute ResolutionAny disputes arising from these Terms or your use of the App shall be resolved through:1. - Apple has no obligation to provide support or maintenance for the App

- In the event of any third-party claim that the App infringes intellectual property rights, FluenSpeak (not Apple) is responsible for investigation and defense---14. SeverabilityIf any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.---15.
